General Terms and Conditions of Sale (GTCS) – Girlys Web Design
1. Subject matter
These General Conditions of Sale (GTCS) define the terms of sale of the services offered by Girlys Web Design, a freelance specialist in :
- the creation and redesign of websites,
- Community management and management of social networks.
Any order implies full acceptance of these Terms and Conditions.
2. Benefits
Girlys Web Design proposes :
- Website creation: design, integration, development, optional hosting.
- Community management: management and animation of social networks, content creation, moderation and reporting
Each service is personalized and described in the quote accepted by the customer.
3. Command
- All orders are made via quotation accepted and signed by the customer.
- The order is considered confirmed after receipt of a deposit of 50% of the total amount (except other agreement).
- Girlys Web Design reserves the right to refuse any order in case of non-compliance or illegal application.
4. Rates and payment
- The rates are indicated in euros and mentioned in the estimate.
- Payments are made by bank transfer or PayPal.
- The balance is due before the final delivery of the project.
- Any delay in payment may result in penalties of 10% of the total amount per month of delay.
5. Time limits
- Delivery times are indicated in the estimate and start after validation of the estimate and receipt of the deposit.
- Time limits may be extended in case of changes requested by the customer or unforeseen events.
6. Client obligations
The customer undertakes to:
- Provide all necessary elements for the performance (texts, images, access, information).
- Verify and validate deliverables within agreed timelines.
- Respect copyright in any content provided.
7. Intellectual property
- The creations of Girlys Web Design remain the property of the provider until full payment.
- After full settlement, the user fees are transferred to the customer according to the use specified in the estimate.
- Girlys Web Design retains the right to use projects for portfolio or communication purposes.
8. Withdrawal
- In accordance with French law, the right of withdrawal does not apply to fully personalized services or services provided on request of the customer.
9. Liability
- Girlys Web Design undertakes to provide professional work in accordance with the estimate, but cannot be held liable for indirect damage.
- Liability is limited to the amount paid by the client for the service concerned.
10. Termination
- In case of non-payment or serious default, Girlys Web Design may suspend or cancel the service.
- The amounts already paid remain with the claimant.
11. Applicable law and jurisdiction
- These Terms and Conditions are subject to French law.
- Any dispute will be referred to the competent courts of Girlys Web Design.
